Inter-Regional Enforcement of Judgments: Can China Learn from the U.S. and E.U.?

Jie Huang, Lecturer, School of Law, Shanghai Institute of Foreign Trade. Judgment recognition and enforcement (JRE) between US sister states, between EU member states, and between Mainland China, Hong Kong, and Macao, are in the category of "inter-regional" JRE. This paper presentation will examine what lessons China may draw from the US and the EU. It first discusses the status quo of the interregional JRE in China. Then it explores how the interregional economic integration demands the establishment of a multilateral interregional JRE arrangement in China. Finally it points out the four most crucial challenges in developing this arrangement. It proposes solutions to each challenge by comparative studies between China, the US and the EU. Lunch provided! Duke Journal of Comparative & International Law Symposium: Terrorism and Changes to the Laws of War

Since Sept. 11, some of the most visible and challenging threats to international security have come from non-state actors. How can international humanitarian law respond, given that the Geneva Conventions and related documents were written from the post-Word War II perspective of state-versus-state warfare? This symposium will address current and future developments regarding the detention and trial of persons suspected of terror related activity; targeting suspected militants and non-state actors and the use of force; and comparative trends in related legal developments. Presenters include professors from Free University Amsterdam, Tel Aviv University, Columbia University, and the University of Texas; a former U.S. Army Judge Advocate General colonel; and a former Clinton Administration State Department official and U.S. negotiator in the International Criminal Court summits in Rome, Italy.
